David L. Simmons was a founding partner of DSV, where he practiced in the areas of construction law, commercial litigation, and business transactions. He represented clients in a wide range of construction matters, including contract negotiation, project delivery systems, public construction procurement, design issues, changes, differing site conditions, delay and impact claims, construction surety bonds, and mechanic’s liens. Mr. Simmons also represented clients in commercial and business litigation matters such as breach of contract, creditor’s rights and collections, implied and express warranties, and negotiable instruments. He also represented clients in a variety of business transactions, including business succession planning, asset and stock sales, mergers and acquisitions, real estate transactions, and entrepreneurial services.
Mr. Simmons participated in a wide range of dispute resolution proceedings in federal and state courts, including mediation, arbitration and litigation. He was a frequent lecturer on the topics of construction law, business litigation, and the remedies of construction creditors. He earned a Doctor of Jurisprudence degree from the Robert H. McKinney School of Law, a Master of Business Administration degree from the Kelley School of Business, and a Bachelor of Arts degree from Indiana University. Mr. Simmons has been named as an Indiana Super Lawyer® in Construction Litigation over many years, as well as being named Top 50 in 2016, and a Top Rated Lawyer in Construction by American Lawyer. In addition to membership in local, state and national bar associations, he served on the Executive Board of the Surety & Construction Law Section of the Indiana Bar Association, was a member of the American Bar Association’s Forum on the Construction Industry, and has been named as a Fellow of the Indiana Bar Foundation.
